The EU Deforestation Regulation (EUDR) applies to anyone placing or exporting timber, cocoa, coffee,palm oil, rubber, soy, and derived products in the EU market. Both importers and traders must comply.
Implementation of EUDR has presented several challenges to exporters of the wooden products. This includes obligations on traceability and providing proof to EU that their wood does not come from deforested or degraded land after 2020. This requires changes to their system and ensuring that data collected is down to harvesting plot. This can be costly affair and even if you manage to collect this data you need to keep this data as part of your export chain and have it saved for 5 years as part of the regulation requirement. There is a requirement for each shipment exported in EU has a due- diligence requirement and there is a requirement of pre-shipment compliance check before you ship your goods to EU. This is to ensure that you don’t face costly rejection of your cargo at port of arrival in EU. No. It is beneficial if you have already implemented a European Union Timber Regulation (EUTR) Due Diligence System, It does help as a good foundation however there are additional requirements which needs to be complied in case of EUDR and there are differences in the regulation which an operator must take note. Some of the differences we have noted are in the area of extent of due diligence required, risk assessment procedures, obligations to include geolocation of plots, providing deforestation assessments in due-diligence process. Further each shipment into EU must have due diligence statement issued and filed with EUIS and there are also downstream obligations as well.
No. EU says that certifications such as PEFC or FSC can only be used by companies to help on their risk assessments to the extent that certification covers. There are additional obligations that Operators have under EUDR regulation for exercising due diligence and they are responsible for any breach and subsequent fine if any.

Traceability is crucial, encompassing not only data on the origin of the logs but also their physical traceability, especially in regions with high risks of deforestation, forest degradation, or legality issues. The EUDR mandates that as an initial action in cases of non-compliance, incriminated products must be physically withdrawn from the market and any substantiated concerns must be communicated to the product's customers.
